2008 Environmental Corrections Bill Signed

Governor Mike Easley signed into law SB 845 (S.L. 2008 – 198) Amend Environmental Laws / Environmental Technical Corrections Act over the weekend.

With the passage of this law it further clarifies the role that the Environmental Management Commission as well as the Environmental Rules Review Commission can play in adopting further stormwater related rules and regulations. BASE would like to emphasize that SB 845 outlines that the Environmental Management Commission shall not begin a procedure to adopt any additional temporary or permanent rules governing the management of stormwater runoff in the Coastal Counties prior to 1 October 2011. Furthermore, any rules that are adopted shall not become effective prior to Oct. 2013.

In addition to the stormwater provisions SB 845 also addresses the confusion regarding the 20% pervious pavement requirements for vehicular parking areas that was slipped into the 2007 budget bill. SB 845 will now exempt all of the 20 coastal CAMA counties from the vehicular surface parking requirements.
