Pender County Comprehensive Plan Gaining Momentum PDF Print E-mail

As many of you are aware the Pender County Planning Department is working through a complete update of the Counties planning and development regulations and land use plan documents.  BASE has been actively involved in many of the discussions and has been steadily working with the planning staff on numerous revisions.  We wanted to make you aware that their will be one more community meeting on August 13th at the Heidi Trask High School Cafeteria from 6:30 p.m. till 8:30 p.m.  The main sections that are being discussed currently are the Goals and Policies, Future Land Use Maps, and Land Use Classifications.  These sections will have a direct impact on the developmental and business communitty.  If you would like a copy of the latest draft policies please send an email to Governmental Affairs Director Cameron Moore at This e-mail address is being protected from spambots. HB1305 "Beach Plan" Goes to the Senate Floor

HB1305 was read in on the Senate Floor late Wednesday afternoon and passed second and third reading by a vote of 42-5 and will now go back to the House for concurrence.  However some last minute amendments were introduced on the Senate floor that changed at least one of the amendments that were changed when the bill was in the Senate Commerce Committee earlier in the day.  Sen. Phil Berger introduced an amendment to reduce the compromise the $1 Million dollar coverage limit back down to $750,000.  The amendment unfortunately passed 43-4 with Sen. Boseman, Brown, Hartsell, and Swindell voting against it.  Sen. Goodall introduced an amendment to increase the surcharges back to the 10% and 20% as it was listed in the bill has it came over from the House.  Thankfully, this amendment failed 6-40.  Additionally, Senator Tony Rand provided a number of amendments which were adopted by the Senate. These amendments are significant and tremendously beneficial.

They include:

  • deleted the January 1, 2010 effective date, meaning that the surcharges of 5% (wind) and 15% (homeowners) will go into effect when the bill becomes law
  • deleted the section on special surcharges, precluding additional surcharges being expanded to COMMERCIAL and DWELLING policies
  • in rate filings, places the burden on the Rate Bureau to prove that proposed rates are "not excessing, inadequate or unfairly discriminatory"
 
Senate Commerce Approves HB1305 "Beach Plan" PDF Print E-mail

The Proposed Committee Substitute (PCS) for HB1305 was voted favorably out of the standing Senate Commerce Committee this morning and now will head to the Senate Floor and could be heard as early as tomorrow.

Governmental Affairs Director Tyler Newman, was on hand for the vote this morning, as he has been throughout this Session, and remarked that this PCS will provide the financial stability that the Beach Plan desperately needs.  This in turn should encourage insurance companies to stay in North Carolina, and will assure insurance availability & affordability in the 18 coastal counties.

Understanding the time-sensitive nature of the current legislative session, BASE along with our state partners at North Carolina Home Builders Association, and other industry partners worked extensively with key committee leaders to get the following changes listed below made to HB 1305.
