UPDATE: JUDGE ISSUES STAY ON BEACH PLAN SURCHARGES/DEDUCTIBLES
While we have been pursuing General Assembly action on this issue, there are also legal actions occurring concurrently. As you may know, Dare County is spearheading an effort of Coastal Counties which have filed suit on these increases (Dare County v. NC Department of Insurance, 09 CVS 1980). On Friday, Judge Pittman issued a stay finding that the Commissioner did not act according to law, in that he did not create a record supporting his findings nor did he use proper procedure, including convening a hearing, as the General Statutes contemplate. The Court issued the stay making no findings with respect to the substance of the Commissioner’s decision, finding only that the Commissioner used unlawful procedure. The result is that the Commissioner, if he wishes to, can revisit the issue using proper procedure to create a record for the action. If the Commissioner properly creates a record for his decision, appeal of the decision would be to the NC Court of Appeals.

Cape Fear Commute 2035 Transportation Plan PDF Print E-mail

The Cape Fear Commutes 2035 Transportation Plan kick-off event will be held at the New Hanover Public Library - Northeast Branch at 1241 Military Cutoff Road in Wilmington on Friday, March 20, 2009. The event will start at 2:00pm and feature speakers from the Wilmington Metropolitan Planning Organization and NCDOT.

This plan will look 25 years into the future and address a broad spectrum of transportation requirements for the entire Cape Fear Region. Nothing will be off limits. The plan will include an examination and evaluation of potential highway, rail, bus, ferry, aviation and bicycle and pedestrian projects in New Hanover County and parts of Brunswick and Pender Counties.

The Cape Fear Commutes 2035 Transportation Plan will include extensive public participation. The committee drafting the plan has created a survey and plans to host open houses throughout area communities over the next 12 months to receive transportation recommendations. Residents of the Wilmington region will be able to offer their ideas by attending these meetings or completing the survey. Enthusiastic public participation is essential in preparing a realistic transportation plan.

All area transportation projects funded by the state or federal government must be included in the region’s long-range transportation plan, which is updated every five years. The Cape Fear Commutes 2035 Transportation Plan is a critical component of the long-range plan. The plan will look at the relationship between population growth and the transportation network. It will also look at impacts to quality of life, health and the environment.

BASE Submits Comments on ELG's PDF Print E-mail

BASE formally submitted comments to the U.S. Environmental Protection Agency's (EPA) in response to the Federal Register Notice:  Effluent Limitation Guidelines and Standards for the Construction and Development Point Source Category.  BASE is extremely concerned about the deleterious impacts that EPA's current proposal would have on our member's businesses.  Our builders and developers are already being crippled by the economic downturn, and the ability of the home buying public to absorb significant new costs, at this point is very unlikely.  At a minimum, EPA's proposed C&D ELG Option 2 would add a minimum additional cost of $15-$45,000 thousand dollars per acre, according to industry estimates.
